Messed up. Kid is pulled over for speeding and his an Xbox 360 in his car. Officers "smell marijuana" which basically means "I have no probable cause to search your car but saying I smell marijuana is a free pass to do so" and search his vehicle. They find an Xbox 360 and confiscate it believing it was stolen (despite apparently checking the serial number to see if it has been reported). Tell the kid he can come pick it up at the station if he has a receipt so he shows up with his receipt and original box and.... low and behold the console isn't there (what a surprise.)

That’s exactly what happened to Kenyatta Hillman when he was pulled over by Orange County Florida sheriff’s deputies last week. According to Hillman, he was pulled over for speeding, but instead of getting a ticket he had his Xbox 360 and eight games confiscated.
In an interview with WFTV Channel 9, Hillman claims the deputies searched his car because he and his friends smelled of marijuana. Inside was an Xbox console with several games and deputies ran the serial numbers to check if the property was stolen. Apparently there have been several burglaries in the neighborhood and Xbox consoles are a big target. Even though the serial number came up clean, the deputy took the game console anyways and told Hillman he could get it back, if he brought a receipt.
With the original receipt and retail box in hand, Hillman went to the sheriff’s station, but no one could find the console in the evidence room. Since Hillman wasn’t arrested or given a ticket, there was no case number assigned to the property. A Sheriff’s sergeant later promised to get the system back to Hillman.
The sheriff’s office told WFTV that it doesn’t believe the Xbox was stolen, but that’s little consolation because Mr. Hillman still hasn’t received his game console back.
No doubt there is probably much more to this story than we’re seeing and it will be interesting to see where the console has been hiding all this time.

last weekend I went to McDonalds and got a Large Vanilla Iced coffee.....it was a large and didnt exactly fit in my cup holder so as I turned a corner....splash.....all over the floor board on the passenger side....being that I was driving, I reached in the back seat and grabbed a T-shirt that I had on earlier and through it on top of the mess........3 days later...low and behold...I get into my car and guess what it smells like?????.....I need to get to the car wash ASAP.

why is that the ones that are doin' the wrong doing almost always get caught....damn if i was doing something wrong im not gonna speed, im going to turn my signals on im going to do everyhing right just so i wont get caught....I DONT GET IT????!!!!!:confused:

And you're going to believe a cop that just stole a kids xbox? He could have been making the whole "I smell weed" crap up. Not all cops are trustworthy.

I realize not all cops are trustworthy. I know that for a personal fact. I'd still believe him over some pot smoking punk kid though.
We also dont know if the cop that smelled the weed is the cop that took the xbox. It could have been one of the civilians that works in the PD. It could have been anyone. It could have also been the cop that smelled the weed. Hell, the weed smoke could have been so strong that both of them got stoned and there never was an Xbox. lol
Bottom line, dont do anything to get pulled over and you dont have to worry about it.

If officers have reason to believe that there is marijuana in the car, and can smell it...they have probably cause to search the vehicle. Trust me, i know alot of the APD officers, my dad was a APD officer for 27 years and i myself will be one in the future

I never been pulled over when I wasnt doing anything wrong. Not once. And I've been pulled over quite a few times. It may have been some simple nothing, but I was still breaking a law.

If officers have reason to believe that there is marijuana in the car, and can smell it...they have probably cause to search the vehicle. Trust me, i know alot of the APD officers, my dad was a APD officer for 27 years and i myself will be one in the future

I got pulled over once because my registration was "expired". I told him to look again, embarassed he told me to keep my nose clean and "carry on". Out where I live if you have dreads, theyll pull you over for anything, including the phantom expired registration.

I've been pulled over 4 times and searched twice. One of the times I was not only searched but given a breathalyzer and a field sobriety test. I drive a nice car and I'm young.

Well your either swerving or driving irradically and/or driving at the time where most cops look for DWI suspects. I will say that i know some cops who like to look for reasons to pull you over and if you give them the smallest reason they will

Well, there was no weed found on the guy in the car. That is a fact or he would have been charged with possession. Just because a cop said he smelled weed doesn't automatically make this kid a pothead. There was no weed found so your logic of calling this kid a dumb pot head is out the window.

I know how to drive. The "reason" I was pulled over and given a breathalyzer was because I was "speeding" but strangely enough I wasn't given a warning or a citation. Oh yeah it was late at night which automatically means I am drunk.

Yes. I am ready to believe the cop. Every time. We put a degree of faith and trust in cops to do their job. We give them powers we wouldnt just give anyone. Or would want to give to just anyone. They have a hellish task at hand each and every day for the whole shift and then they have to deal with people like you that are ready to string them up at the drop of a hat.
If you can do the job better, go get hired as a cop. They put their lives on the line to make sure we can have some form of a semi-sane society. Yes, I am ready to take the cops word for it. The mass majority of cops are honest and do their jobs just as they should. You want to knock all cops because of the actions of a few bad apples.

What part of this case don't you understand?
The cop pulls over this kid and says he smells weed. He searches the car and finds NOTHING. He sees the Xbox and decides to run the serial numbers because XBox's have been stolen lately. THE SERIAL NUMBER comes back clean. It is NOT stolen. He takes the kids Xbox anyway? WTF? You really don't see anything wrong with that?

The cop took it. Does it get anymore clear? The cop had no reason to search his car but did anyways. He saw an xbox and ran the serial number. The serial number came up NOT STOLEN but he took it anyways.

Someone stole the Xbox. I just went and read the actual story from the tvstation site. The whole thing seems fishy to me. Everyone involved is acting really bizarre about it. All of them. the xbox owner. the police. everyone. they all seem pretty weird about it. Something not kosher happened and that's for sure.
I still stand by what I said to start with though. Dont break any laws and you generally dont have to worry about being pulled over. I know people will argue with that. But 99% of the time, those that are pulled over broke some law.
The guy will get his xbox back and that's what matters.
My own theory is that the cop knows the kid and they're together making a play on the county to get a free xbox.

OK! first of all, the officer was probably nice enough and let you off with a warning after the breathalyzer and testing. You should be thankful you didnt leave with a ticket. Second of all, cops will pull over Speeders and anyone who they think is a danger on the road. That being said they had the right to pull you over and give you any kinda test they wanted too. A) because it was late night and that is a high point for DWI's. The police are just trying to do their job. This is what they do, try to keep the streets safe for everyday people use. He wasnt trying to be an *** by pulling you over while u were speeding, they have their reasons. So just do what the officer says, and move on with ur business. And if you get fed up with it, next time you do get asked for a breathalyzer and any kind of testing you have the right to say no. Or ask for the supervisor or sergant on duty and they can come and talk to you. Then after that they will make their judgement on whether or not you are fit to leave

Says if you refuse to take a breathalyzer your license is revoked for 6 months and costs $125 to get it reinstated. Also says refusing to give up your license to the officer is a class B misdemeanor.
If this is false information that is news to me but it is what I have always heard.

If you refuse to take the breath test, your driver's license will be automatically suspended for 6 months. The suspension increases to 2 years if you have had a previous alcohol-related or drug related enforcement contact within 10 years of the date of your arrest.
The police are now authorized to confiscate your driver's license at the time of a DWI arrest for refusal to take, or failure of, a breath test. The officer will issue you a temporary driver's permit that expires on the 41st day after the date of issuance. The fee for reinstating your driver's license after suspension has gone up to $125.00.
FAILURE TO SURRENDER YOUR DRIVERS LICENSE IS A CRIME:
It is a Class B misdemeanor if you fail or refuse to surrender your driver's license after law enforcement personnel have demanded it.
There was also a "no refusal" weekend in Austin during Halloween where if you refused to take a breathalyzer test you were forced to take a blood test.

Why cause unnecessary problems? If you arent doing anything wrong, you dont have much to worry about. I dont understand why it's so hard to grasp that.

If an officer shows up on my front porch without a warrant and asks to search my house he will not be entering. He may go get a warrant and come back but he will not enter without one. I apply the same logic to a breathalyzer test. What is so hard to grasp about THAT?

You have a right to privacy in your home...and a warrant would normally be in line...
You have no such right in your car...
You do have the right to refuse a breathalyzer test...but you'd surrender a priveledge...DRIVING...

Doesn't mean an officer should have the right to order me to do one.

Doesn't mean an officer should have the right to order me to do one.
We, as citizens, give him/her that right when we hire them to do that job. As a whole, the people have decided that they (the police) can order you to do that whenever they see fit.
I dont like having to wear my seatbelt. It's a private matter in my opinion. But the people decided that we all need to wear them. So I wear it and comply with the law, or I dont and I suffer the penalty. If I hate it enough, I fight to have that law changed. If you hate breath tests enough, you'll fight to make that law change.

If an officer shows up on my front porch without a warrant and asks to search my house he will not be entering. He may go get a warrant and come back but he will not enter without one. I apply the same logic to a breathalyzer test. What is so hard to grasp about THAT?
Laws different for both of these cases. In the case of the home the officer would have to have a warrant otherwise it would violate your 4th amendment based on mapp v ohio. Courts have ruled that you don't have that same right to privacy on the road so you a required to give the breathalyzer as its in public.

I realize not all cops are trustworthy. I know that for a personal fact. I'd still believe him over some pot smoking punk kid though.
We also dont know if the cop that smelled the weed is the cop that took the xbox. It could have been one of the civilians that works in the PD. It could have been anyone. It could have also been the cop that smelled the weed. Hell, the weed smoke could have been so strong that both of them got stoned and there never was an Xbox. lol
Bottom line, dont do anything to get pulled over and you dont have to worry about it.
Why would you believe him over the kid? Just because he's a cop? That explains a lot

I never been pulled over when I wasnt doing anything wrong. Not once. And I've been pulled over quite a few times. It may have been some simple nothing, but I was still breaking a law.

I would believe the cop because he's the cop. Most of the time, not just any old person can go and become a cop. Several reasons for that, but for the most part not just anyone has that job. I hold them to a higher standard and they hold themselves to a higher standard most of the time.
I saw a photo of the guy in question. He doesnt look like a kid really to me.
I still think there's something fishy going on with the whole thing.

Messed up. Kid is pulled over for speeding and his an Xbox 360 in his car. Officers "smell marijuana" which basically means "I have no probable cause to search your car but saying I smell marijuana is a free pass to do so" and search his vehicle. They find an Xbox 360 and confiscate it believing it was stolen (despite apparently checking the serial number to see if it has been reported). Tell the kid he can come pick it up at the station if he has a receipt so he shows up with his receipt and original box and.... low and behold the console isn't there (what a surprise.)

I got pulled over for doing 59 in a 60. The speed limit on the road i was on had changed from 55 to 60 about a week prior to this. So i was riding my bike at an indicated 65 (all motorcycle speedos are off by 5-10 mph) and got pulled over for what the cop thought was 4 over. When i told him the speed limit had changed he didnt believe me and said i was lying until he looked about 60 yds in front of us and there was a speed limit sign that said 60:rolleyes:

Well your either swerving or driving irradically and/or driving at the time where most cops look for DWI suspects. I will say that i know some cops who like to look for reasons to pull you over and if you give them the smallest reason they will
I've been pulled over twice for suspicion of DUI.
I wrote on here before about pulling out of the bar/grill with no headlights on and the officer made me get out and say my ABC's then I started laughing and he really thought I was on something...
The other time I worked about 14 hours and went to my g'friend's house( now my wife) an hour a way. Was driving home and got pulled over for swerving out of my lane. Considering it was about midnight, the officer had every reason to suspect something was wrong with me. Fortunately I was only about 15 miles from home and he could have given me a ticket for driving impaired(sleepy) but he didn't.
Both times the officers checked me out and asked me to get out of the car but didn't do a search on the vehicle. I did laugh at the one for asking me to do my ABC's, but other than that it is "yes sir, No sir" the whole time. everything they do is on film, so just let them do their job and go on.

That crossed my mind, and I have taken mine to G'ma's house or whatever like for Thanksgiving weekend with all of the cousins.
Most of my friends had one too, though. It's like a cell-phone, even the po' people have them.
Hard for me to believe the x-box was taken by the 5-0 just because...

Very true. but if the kid really was smoking weed..... he should have stayed home
