Why do some schools get to copy logos from colleges and pros unnoticed, but others have to change. Wisconsin made The Woodlands change it's logo, but a blue copy of it is okay for a Ft Worth school? You see SMU ponies, Green Bay G's, and Denver broncos that go unchallenged. What's up with that? It is just a matter of time?

It is up to the university holding the trademark and/or copyright to defend such. In the case of Wisconsin, there are two possibilities: (1) the fact that it is blue rather than their Wisconsin red makes it less of a clear cut violation and, at least, a lesser substitute for merchandise sold by the University of Wisconsin at Madison; (2) it has not yet come to the attention of the University. If the later, this posting my do it.

Universities most decidedly care about that kind of money and one can hardly blame them for doing so, even if it does seem petty to some of us for them to come after high schools. But the copyright/trademark laws are what they are, and the trademark must be defended or rights to its exclusive use and the revenues derived therefrom can be forfeit.

It's all about the "mighty dollar"...that is why pro sports have really just become a business...it is not about the sport and wanting to play, that is why high school sport's are still the BEST...

It is now happening at the high school level as well. That is one reason why I am "worried" about the increasing number of high school games being broadcast. While I appreciate being able to see the games, it is inevitably leading to the increased commercialization of high school sports, especially football. Given the school budgets, the pressure to find more sources of revenues becomes ever greater. But I agree that high school sports are still far and away "the best."

Agreed, copyright/trademark laws exist for a reason, but should San Jose State's merchandise sales be threatened that much in Katy, Texas?
I think it mostly has to do with bored attorneys!:(

I can understand and nod in agreement. And attorneys are not my favorite types either. But suppose a company makes the merchandise for Seven Lakes in Katy and decides it would be a good idea to market the shirts and hats on line. Those are perfectly good substitutes for what San Jose State is selling and/or getting paid royalties on for use of their logo. I doubt that is major bucks in that case, but......

That Fort Worth school that you're referring to is OD Wyatt! As long as there is a Criss coaching the Chaps, they'll be wearing that logo....until Wisconsin goes after them that is.

I forgot about Westfield as well. For a couple of years, Westfield just had the black helmet with the players' number in red on their helmets, as well as the old school Denver Bronco when they went to the championship game against Tyler Lee.

That logo is the face of the school and when you see it plastered on something, you think of the university. You can't let it get slapped on things that you don't see and approve. At the high school level, one of the main problems is quality. Many booster club shirts are cheaply done, sometimes they have spelling errors on them, etc. No university wants people walking around with el-cheapo t-shirts and a university logo, because it looks bad.
You also have to remember that if it comes to the attention a school, you have to take action or else you risk letting it go into the public domain. With a school like UT or A&M, there are all kinds of businesses that would love to use school logos in marketing. You can't pick and choose who can use your logo and who cannot use your logo without authorization. Much of the time, the college doesn't really care if a high school has a similar looking tiger on its football helment. The problem is that if you are aware of the infringement and don't do anything about it, you lose legal standing to complain when Big Daddy's Strip Bar and Bait Shop starts using it on their promotional materials. If they can prove you knew of earlier violations and did nothing, then you basically give your approval to everyone to use it.

I never thought about it like that.
I do that Coach McCoy and the Graham Steers are now using the UT-Longhorn logo on their helmets, and in the middle of the Steers homefield.

They tried taking the block off the middle and make it pointy. Wisconsin still said no can do.

See I don't understand that. If it isn't their logo then it isn't their logo. If the Woodlands would have made the change as you said then at that point it wouldn't have been Wisconsin's logo anymore right?

OK so how about all of the peewee teams that use the uniform of the Cowboys, Packers, Broncos, Steelers etc? I guess their parents buy the real stuff form the NFL so that is OK.
How about fight songs? I swear, I hear "On Wisconsin at least four times a year!

Our local jr. football league buys NFL licensed decals. I believe they fought that battle years ago.

didnt go to arbitration --- CISD didnt want to spend any $ on any legal fight & told TWH to change --- that is what usually happens --- most districts rightly so cant justify spending tax $ on something like a logo

It does seem to be a total waste, rather than fighting the issue (colleges employing people to protect their brand), why don't they publish acceptable use guidelines such as:
can be used by any High School (only) and under the following conditions:
- School is more than 500 miles from the college campus
- School has received cross promotional approval where each school must reference the owning college program
This would allow them to keep separate and distinct brand and promote their college. In the case of TWHS, why would Wisconsin set up a 'sister' high school program where they would recruit and educate TWHS students on the virtues of Wisconsin to gain more qualified out of state students....
Rather than look at the glass half full, we should throw it on them! :D

yup South County uses exclusively NFL nicknames on the youth teams. Some of the coaches will deviate from the color schemes like using a black helmet with orange stripes for the Bengals( Looked really cool BTW:D) and stuff like that, but they use the NFL team logos.

IMO, TWHS needs something a little more exciting than the plain block W. i still prefer the logo withe the Highlander using his sword. they have a bad_$$ mascot and a blah helmet. I understand the "classic" look, but to me it might as well just say "Football" on their helmets with the current set up.

One thing I will say is that The Woodlands is a nationally recognized school, and not just for football or athletics period. You excel and you draw attention to yourself. I'd take it as a compliment. Besides, I've always thought people from Wisconsin were a little weird.;)

Without reading everyone's posts (I read most of them), the answer boils down to $$$ and timing.
For example, Wisconsin's logo was trademarked before TWHS was even TWHS. So, Wisconsin was able to sue for trademark infringement. Where, at the same time, Westfield (just down the road) uses the same logo, but has used it since before UW trademarked it, but uses the Broncos logo on their football helmets (after the NFL trademarked it... the NFL doesn't even do a reveal until after they have trademarked every possible version).
Regardless, usually the solution is only a licensing fee away.
Especially if you have a contract for someone like Nike, Under Armour, or Reebok to supply the uniforms at no cost to the school. And, when you look at a lot of school's uniforms, you can tell those aren't being bought through the district or a booster club- when there are 3 colors of jerseys and and 3 pants, that's not district money... no matter how much money that district or the parents have.

Yep, Cooper has to quit using the logo that they were using because it looked very much like Washington State's. Cooper's new and copyrighted logo looks a lot sharper anyway! It's the one I use as my avatar.

Seems Disney or whoever had the trademark rights to the Superman S wanted some crazy sum of money, way up in the hundreds of thousands, to let them keep using it. That is what I remember of the story, can anyone else fill us in on what exactly happened and what became of it?

Didn't 2A Schulenburg have some problem with the Superman S logo a few years back and had to change it? Seems like I remember some controversy about that.
Strawn had a problem with using the Superman S logo on a tee shirt. Marvel Comics (I think) got really hacked off about it and threatened a suit immediately. I believe that Strawn dropped the sales of the shirts immediately and then changed the appearance on their subsequent offerings.

the Snyder Tigers use the Superman S logo on their helmets, but I haven't heard any complaining about anyone making them change their logo.
