Just wanted to know everyone's thoughts on the University of Wisconsin making The Woodlands change the red "W." I for one think it's silly!! I guess it's what the alums want!

I have relatives from Wisconsin, my dad is from Racine. One is even an alum from UofW and they weren't offended by it at all. My uncle used to send me hats etc. but I couldn't wear them to games because the colors weren't even the same, except for the red W!! The W is a little different

The OD Wyatt Chapparells use it, except their's is baby blue.
I guess Michigan will go after Spring HS next. Colorado St will go after Elsik, Western Michigan will go after Westfield. UT will go after Dobie....I hate the world...it's getting sillier and sillier.

The CISD superintendent called them a year ago hearing that there may be a problem and they told him not to worry about it. Then, when The Woodlands played on ESPN, alot of alums saw it and complained, hence the change of minds!!

I ouldn't be surprised if isconsin came after your computer like they did mine. I still don't understand hat the big deal is, but I ouldn't fight them. They can be very persuasive. It could happen to you.
I also heard that Penn State is going after all teams ith an all hite helmet. Don't kno if it's true or not.

Does anyone remember the issue a DFW school had with Kansas State a few years back? I can't recall which school it was but it was a similar thing -- maybe Flower Mound?? Not sure. Someone mentioned Tulsa Union and the split U similar to Miami --- I know that they actually pay for the use of that logo (probably as the result of a law suit).

As far as I know Mizzou and Wisconsin are both public schools, correct? Theoretically, they should not be able to own rights to any logo associated with the school. Not if public funds were used to create it.

Reminds me of a funny story from Utah:
A city councilman in Utah, Mark Easton, had a beautiful view of the east mountains,until a new neighbor purchased the lot below his house and built a new home.
The new home was 18 inches higher than the ordinances would allow, so Mark Easton, mad about his lost view, went to the city to make sure they enforced the lower roof line ordinance. The new neighbor had to drop the roof line, at great expense .

Our HC "designed" a new Bulldawg logo and had it copyrighted personally. He allows the school to use it, so anyone coming after Cove would be met with the fact that legally, at least, our logo CANNOT be said to be a copy of anyone else's. In fact, maybe we should go after some of them bulldog schools, huh? :D :D :D
(At least I think it is his personal copyright. It may belong to his foundation)

These colleges suing these high schools over copyright infringement are just down right snively. They are doing this mainly to try and bring publicity. Why else would they do this? In a court of law, they have to prove first they had the logo first. They have to prove that the logo is close enough to theirs to cause one to be confused. They have to prove that The Woodlands using their logo is causing harm or confusion to their school. Yes, a public entity can own a logo. Southlake owns theirs, and are very protective over it. The difference is that Southlake uses theirs for the program, and not for profit. A school district can fight these cases, and probably win if they wanted to. Doing so, will cost a school district considerable money and resources. 2 things that the school district's do not have, and these college's know. Also, by fighting the case; the school districts are playing into the hands of the greedy colleges by giving them what they want, and that's free publicity. The real sad part is that these colleges have an opportunity to use this in a positive way. Instead, they chose to bully. I hope some Texas High School footballers take these pracitices into consideration when deciding who to sign with.

In the case of the Woodlands High " W " -- at the opening of TWH --the HC liked the Wisconsin "W " =---- he had a booster that is a high - power attorney research it. The attorney discovered that if there was at least 20 % difference it was NOT a copyright infringment. He then had another booster that is a prominent architect design a logo that had at least 20 % difference.
Therefore Conroe ISD would probably win in a lawsuit --- but since it appears that WISCONSIN will allow a "phase out " rather than a costly immediate replacement -- CISD chose not to spend the bucks needed to fight it
BTW ---the only reason I used the terms "high power attorney" and "prominent architect" was to clarify that it was people that knew what they are doing & not just some parents opinion

Look, we all think that this type of thing is silly. But from a copyright standpoint, U of W has to do this.
The 20% difference is a debateable point in law. 20% of what? Shape? Color?
Also, a court of law would have to answer the question of whether one could reasonably confuse the marks. 20% is a standard often used, but it is not the law - the law if if one could reasonably confuse the marks.
If they allow others to use their trademark (or a close varition thereof), then they lose ownership of their trademark. Then their logo (which fuels a lot of sportwear sales) can be used by anyone for any reason.
As silly as it sounds, you just have to do this if you're a college if you want to continue to own your trademark.

Without trying to justify this (as I think it is silly), but a trademark holder must act to protect the uniqueness of its trademark/logo or it loses its position with respect to the uniquesness of that trademark. So in a sense, once Wisconsin finds out that someone is utilizing its logo, or one sufficiently similar, it must act to protect it.

I just want to go on record as saying this whole affair is ridiculous. I do not wish to debate anyone or have an arguement over the sanctity of Wisconsin's W. For this particular case, the legality is redundant to me. Whatever resources the university put into this endeveaor would have produced more beneficial results if directed into watching paint dry.

Cheese... lots of cheese. Actually, Wisconsin is a very nice place to visit. I've spent some considerable time in Madison, which is not all that different from Austin. Perhaps a bit less crowded, a whole lot colder in the winter, but still both a major university town with a huge school and the state capital. And evidently a "W" that they are quite proud of.

I have my own "W" for this one "Whatever"! Wisconsin should be ashamed of themselves for this. 40 schools in 26 states? The Woodlands W, yes it is red and is similar but they didn't rip off their logo.
BTW: Whatever became of the Seattle Seahawk and Texas A&M dispute over use of the phrase "The 12th man"??

I actually thought about bringing that up! But all well, you did. So it's all good!:cool:
I think this gets said every so often in these types of discussions, but the institutions do not want to do this either, they have to or lsoe their right to the trademark/logo.
Ex. The Washington Huskies decide they like the logo and start to use it. If they can show that Wisconsin knew about the Woodlands/etc. they could argue that Wisconsin has failed to defend it and no longer have it.
In addition, I believe it is possible in that scenario, for The Woodlands to register it and then charge the rest.
Again, these schools do not wish to enforce it, and typically have sent letters for some time. Many will offer the logo at a pretty reasonable price.

You have a good point I never thought of it in that way. I also think it is very unoriginal of school's using or stealing other team's fight song. You can hardly ever go to a hs game and not hear "on wisconsin" or "The Notre Dame Victory March". My school uses the most copied one in "on wisconsin" I cannot tell you how many times we have played another team with that same exact fight song.
You would think school's could come up with their own fight song?

I can't get a picture, but I thought for sure that Trimble Tech had a Double T on their football helmets.
Part of the reason I don't mind high school teams copying colleges and the pros is that it can build up loyalty to said team because of the common bond.

Regarding school songs - someone posted here that many of the new high schools go to a college and get permission to use their fight song, colors, mascot and a logo replication. Most colleges are fine with it. I think it was a newer Katy HS that went with San Jose State's stuff?
But, again remember - Wisconsin had only been using the moving W for 11 years! It's the alphabet for cryin' out loud - it's not stealing a slogan or something else directly associated with a trademark.
I'm definitely rooting against the Badgers for awhile - unless theire playing OsU.

I could'nt disagree more. It's not stealing a letter from the alpahbet but a design that just happens to involve that letter. If it seems so simplistic to you then why did'nt other schools who's name begins with W come up with it?
Wisconsin may have come up with it 11 years ago but they were the first. If you don't protect that or anything else then people run wild. If it was so special for Wisconsin then you would see that logo being used for more than just football, it would be donned by the baseball team as well as every other. It's not. So it may just be a simple letter to you but that letter is the symbol of Wisconsin football and not Woodlands football. It would be like me starting a home improvement wharehouse called the "House Depo" and making my slogan "You can do it we can help". That would'nt fly in a second and neither should the W for Wisconsin if they so choose to enforce it.

Yea it was Seven Lakes. They also have an alternate jersey that is very similiar to Miami's but with a bit of navy blue. I really like the Katy emblem for that reason as well as Katy Taylor, SLC, and a couple of others because they are so original. I have never seen a logo like Katy's or SLC's and even though all you would have to do is change the state behind the mustang for Taylor, it still comes off to me as unique. I have disliked Wisconsin for a while but this does make me like them even less. I could see the 20% difference in the W; they did change the middle arch to be flat unlike the other 2.

Only one other school (Abilene) has the same fight song as us and no college does. Our football helmet is plain. Our L logo for baseball is not used by any other college. We have nothing to worry about and I am glad our plowboys in the administration were original enough to come up with stuff on their own.

You have a good point I never thought of it in that way. I also think it is very unoriginal of school's using or stealing other team's fight song. You can hardly ever go to a hs game and not hear "on wisconsin" or "The Notre Dame Victory March". My school uses the most copied one in "on wisconsin" I cannot tell you how many times we have played another team with that same exact fight song.
You would think school's could come up with their own fight song?

I'm suprised we haven't played more times with the Victory March. Last year was the first time I actually remember it, against Monroe Ouachita. But they used it as their School AND Fight song. Very weird. We heard their version like twice all game so no worries. ;)

I am glad that Lewisville has some pretty original stuff. Only one other Texas school that I am aware of shares our nickname (Farmersville). Only one other school (Abilene) has the same fight song as us and no college does. Our football helmet is plain. Our L logo for baseball is not used by any other college. We have nothing to worry about and I am glad our plowboys in the administration were original enough to come up with stuff on their own.
Actually, I think Washington and Lee uses the same fight song as AHS and Lewisville. They use a different intro, though. I think it may be ACU's fight song, too.

Yea it was Seven Lakes. They also have an alternate jersey that is very similiar to Miami's but with a bit of navy blue. I really like the Katy emblem for that reason as well as Katy Taylor, SLC, and a couple of others because they are so original. I have never seen a logo like Katy's or SLC's and even though all you would have to do is change the state behind the mustang for Taylor, it still comes off to me as unique. I have disliked Wisconsin for a while but this does make me like them even less. I could see the 20% difference in the W; they did change the middle arch to be flat unlike the other 2.
An interesting side note -- before The Woodlands High was built -- the high school was McCullough ( now the jr high to TWH ) --the original logo was McC --but after several years it was changed to a MAP OF TEXAS WITH A FOOTBALL FIELD IMPOSED OVER THE MAP ( bring up thoughts of SLC ?? )

Is that because it's the same as 50% of all HS's around including Rydell High of Grease?

Personally I dont care too much about the " W " --- I would like to see
" TWH " as a logo -- I think it is unique ( plus it has a dual meaning -- either THE WOODLANDS HIGH or THE WOODLANDS HIGHLANDERS )
as another side note ---- during the 2003 state run -- some one came up with using the picture of Mel Gibson in BRAVEHEART except instead of the blue warpaint from the movie --it had green ( TWH color ) war paint . Dont know if permission was granted or paid for ---- but it was used on a lot of Jumbo-TRONS around the state ( and broadcast around the state during trhe title game ) plus it is the opening for the DVD of the 2003 highlights

I like for high schools to have their own look, own fight song and own alma mater. Summit has their own songs, composed just for that school so no one else has them.
And the logo is unique as well (well, I guess Michigan State could argue it is similair to theirs....)
