I have various opinions, 99.9% of them negative, but I'm told by a local attorney that if they didn't put up a bit of a fight about the logo, their trademark could eventually be found to be worthless the next time someone bigger tries to use it.

They trademarked it in 04, we've been using something similar since 01 or 02. At least ours is a bit different, Conroe's looks pretty much identical.

It be interesting to know if the student that originally drew it knew anything about Mizzou's logo - probably did - even if only from memory.

Lame deal to me though - gimmmeee a break.

I'd say unless the student had some psychic moment, there is no doubt the image got its start with the mizzou logo. Or maybe mizzou stole it from someoen else and was just smart enough to trademark it first.

Lesson to all the other schools out there.... trademark your damn logo if you like it.

I'd hope that Mizzou would let us license the logo for a nominal fee. That way we can keep our tiger and they can save face and show a court of law, down teh line, that they defended their trademark.

The New England Patriots allow Valley HS to use the Pats logo. Hell it's good advertising on NE's side.

Jeez...

I can't believe that a college doesn't have anything better to do, than pick on a public high school. Their action right now is "diluting" their trademark.
I hope they get the negative publicity they deserve from this. I hope AMC consolidated fights this. I think that Univ. of Misery will have trouble proving that a school in Texas using a logo that AMC used before Misery trademarked it will "dilute" their image. I believe that in a court of law U of Misery will have to prove this. Also, AMC is a public school; so I'm guessing that they will get some wiggle room on this. I'm glad to see that based on the article that the students are positive about the prospect of finding a new logo. It looks like U of Misery is cutting off their nose to spite their face.

The article says that they saw our logo from a picture of abraham daily in the newspaper a couple weeks ago...

I'm surprised they hadn't seen it before considering two former consol athletes play for missouri, Brant Scott plays football and Marcus Watkins plays basketball

It's Brent Musberger's fault.

I'm told a lot of good people on both sides are working hard to turn this into a win-win situation. I'll let y'all know how it works out.

They could just end up licensing it back to us for a nominal fee. That would be the best case.

Hey, the kid made a mistake... If he were a professional and was paid to do it, then that's one thing... But a student... I hope you're right that they'll work this out... It's all so silly to begin with... such a small scale issue for Mizzou to even bring it up... They should be flattered...

the kid did not make any kind of mistake! he was being featured in the paper for being a defensive standout on the basketball team. he was holding one of the teams basketballs in a basketball article. what should he be holding?? a ping pong ball? mizzou is being extremely anal about this. the fact that they noticed it in that article this far after we started using the logo is idiotic. i am perplexed.

Missouri must take some actions to defend their trademark or they jeopardize its value and uniqueness to the university. It matter not how long someone else might have used it, Missouri own the trademark. Does your booster club sell merchadise with the logo on it? Do other schools also using it do the same? if so, and I would guess the answer is a decided yes, then I think you can see where the University must take some steps to defend the value of its TM. Hopefully, assuming you would like to keep it, some reasonable liscense arrangement could be worked out. If not, it could be fun for the students and the community to develop a new logo. This is not the first time that something like this has come up.

I disagree. How is AMC using a similar logo, jeopardize its uniqueness? The AMC tiger is a different color for one. To me, it matters how long they had the logo. I now what the trademark law is; but the law is convoluted. In this case, U of Misery needs to show that AMC using a similar logo is infringing on their trademark. The Dallas Cowboys use a star. Are they going to go after everyone who uses a star?
I know that Southlake has their logo trademarked. We at the Trinity booster club were attempting to make Tshirts for our game at Texas Stadium. We were not able to due to the trademark you all have on the dragon logo. This was actually the first I heard of a high school team trademarking a logo. Does any other high school have their logo trademarked?

i actually believe that the University of Wisconsin had a case against The Woodlands a few years ago...they threatened legal action if we failed to change our "w" from block tip in the middle to the pointed tip that we have now.

I don't think he was talking about abe... i think he was talking about the kid who designed our logo

This is the same thing a local attorney relayed to us. If they don't defend their "right", they lose it. I understand that. It seems to me that they could lease it back t us for $10/year or something. That way, they retain their legal rights, we recognize those rights, all is well.

For the record, the merchandise sold using those logos are only by our Non-Profit Booster Club. All the money the club makes goes back into scholarships for graduating seniors and items that the various sports programs need. All sports, not just football.

I think there are a few window decals at Klein Collins that have a similar logo to Mizzou's. I've lost count on HS helmet decals that look like Kansas State's Wildcat, the Denver Broncos, or the Atlanta Falcons.

Yeah, I went to a track meet this weekend and saw K-Sate (Angleton), and the Atlanta Falcons (Huffman-Hargrave I think). Why would any college want to stop HS from using their logo. Seems like good cheap advertisement to me.:)

Actually, in 1964 the presedent of Ford Mo. Co. attened an SMU football game. Following a rout of some SWC opponent he visited with Hayden Fry and told him that Ford had designed a new sports car, but it did not have a name. It did after the Mustang rout. Soon there after Fry received the first Mustang off the assembly line. It of course was painted Red and Blue. He said, he sold it for a few hundred bucks several years later. And admits he made a mistake.

i would say that those are pretty identical. if we change the color of ours and its nearly identical, the direction the logo faces doesnt change it from being nearly identical either.
